By accessing or using Heritage Healed, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

2. Services

Heritage Healed provides digital photo restoration services. You may submit photographs for restoration, and we will perform the services as described on our website.

Our services include but are not limited to:

  • Color correction and restoration
  • Scratch and damage repair
  • Tear and fold repair
  • Image enhancement and sharpening

3. Payment and Refunds

Payment Processing

All payments are processed securely through Stripe. You must provide payment information when placing an order. Prices and fees are as listed on the Service at the time of purchase.

Refund Policy

Refunds are handled on a case-by-case basis. If you are not satisfied with the service, please contact us at [email protected]. Partial or full refunds may be granted at our sole discretion.

Refund requests must be made within 14 days of receiving your restored images. To be eligible for a refund, you may be required to provide a reason for your dissatisfaction.

4. User Responsibilities

As a user of our Service, you agree to the following responsibilities:

  • You warrant that you own or have permission to submit any photographs you upload.
  • You agree not to submit any material that is unlawful, offensive, infringes on intellectual property rights, or violates the rights of any third party.
  • You are responsible for maintaining the confidentiality of any authentication credentials and for all activities that occur under your account.
  • You agree to provide accurate and complete information when using our Service.
  • You will not use the Service for any illegal or unauthorized purpose.

5. Intellectual Property

Our Content

All content on the Service, including text, graphics, logos, images, and software, is the property of Heritage Healed or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Your Content

You retain all rights to the original photographs you submit. By submitting photographs, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display the photographs solely for the purpose of providing the Service.

We retain the right to use non-personally-identifiable rendered images for marketing and portfolio purposes unless you explicitly request otherwise in writing to [email protected].

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Heritage Healed disclaims all warranties, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of content
  • That the Service will be uninterrupted, timely, secure, or error-free

We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

7. Limitation of Liability

To the maximum extent permitted by law, Heritage Healed and its officers, directors, employees, and agents shall not be liable for any of the following arising out of or relating to your use of the Service:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Errors, mistakes, or inaccuracies of content
  • Personal injury or property damage resulting from your access to or use of the Service
  • Any unauthorized access to or use of our secure servers and/or any personal information stored therein

In no event shall Heritage Healed's total liability to you for all claims exceed the amount you paid to us for the services giving rise to such claim, or one hundred U.S. dollars (USD $100.00), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

8. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Dispute Resolution

Any dispute arising under these Terms will first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally, both parties agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief) through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal or state courts located in San Francisco County, California.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any changes by updating the "Effective Date" at the top of these Terms. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
